The
stamping of documents in the state of Maharashtra is governed by the
provisions of Mumbai Stamp Act, 1958. If the agreement
for sale is executed (signed) by the parties before the stamp duty is paid,
the document is liable to be impounded by the stamp office. Therefore, the purchaser must take care
to have the document stamped or typed on a stamp paper before the parties to
the agreement sign it.
If
the stamping of the document is to be arranged by the purchaser, then he
should tender the document in blank (i.e. without signatures, without filling in other details) to the
General Stamp Office in case of city of Mumbai and in other cases to the
local stamp office where the
flat is situated with the amount of duty to be where the flat is situated

is substantial, then such stamp duty can be paid by pay order drawn on
Reserve Bank of India favoring the Superintendent
of Stamps. The amount of stamp duty is paid by challan in R.B.I. On tendering
the document as above to the General
Stamp Office, the said document can be collected from the stamp office on
showing receipt issued by the stamp office
and on surrendering the token issued to the
